2. Acceptance of Terms

By accessing or using FlashAudit at flashaudit.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users worldwide.

3. Description of Service

FlashAudit is a website audit tool that analyses publicly accessible websites and generates reports covering performance, SEO, content quality, accessibility, and related factors. Reports are generated using automated processes and are provided for informational purposes only.

4. Accounts and Registration

You must create an account to access your audit reports. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information when registering. You must be at least 18 years old to use the Service.

5. Acceptable Use

You agree not to:

• Use the Service to audit websites you do not own or do not have explicit permission to audit
• Attempt to reverse engineer, copy, or resell any part of the Service
• Use automated scripts to make excessive requests to the Service
• Attempt to gain unauthorised access to the Service or its systems
• Use the Service for any unlawful purpose

6. Subscriptions and Payments

FlashAudit offers free and paid plans. Paid subscriptions are billed monthly or as one-time purchases. All prices are in USD unless stated otherwise. Payments are processed securely by Stripe. By subscribing, you authorise recurring charges to your payment method. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months, except where required by applicable law (including the New Zealand Consumer Guarantees Act 1993 where it applies).

7. One-Off Credit Packs

Credit packs are non-refundable one-time purchases. Purchased credits do not expire. Credits are applied to your account upon confirmed payment.

8. Free Plan

Free plan users receive one audit per month. FlashAudit reserves the right to modify free plan limits at any time with reasonable notice.

9. Intellectual Property

All content, trademarks, software, and materials on the Service are owned by or licensed to Parallax Labs Limited. Audit reports generated for your website are yours to use. You may not reproduce or resell the Service or its outputs without written permission.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Audit results are automated and may not be complete or error-free. FlashAudit does not guarantee that implementing recommendations will improve search rankings or website performance. To the extent permitted by law, we disclaim all implied warranties.

11. Limitation of Liability

To the maximum extent permitted by New Zealand law and applicable international law, Parallax Labs Limited's total liability for any claim arising from use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Consumer Rights (New Zealand)

Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to your use of the Service.

13. Third-Party Services

FlashAudit uses third-party services including Stripe (payments), Google (authentication), and Neon (database). Use of those services is subject to their own terms and privacy policies.

14. Termination

We may suspend or terminate your account if you breach these terms. You may delete your account at any time by contacting flashaudit@parallaxlabs.co.nz.

15. Changes to Terms

We may update these terms from time to time. We will notify users of material changes by email or via the Service. Continued use after changes constitutes acceptance.

16. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand, without limiting your rights under any applicable consumer protection laws in your jurisdiction.
